Fairplay Short-Term Rental Rules
Fairplay caps its short-term rental permits at 20. Whether the Town or Park County handles your property can depend on its water and septic setup.
Last verified: November 3, 2026
Well and septic homes go to the County. The Town says properties served by a well and septic tank are outside its jurisdiction and should use Park County's program.
How Permits Work
- Ordinance No. 4, Series of 2022 sets the Town's rules for permits inside town limits.
- The property owner must apply and provide proof of ownership.
- The Town accepts only complete applications.
- When the cap is reached, new permits open only if one is revoked, surrendered or not renewed, or if the cap rises as housing units are added.
- Renewals require an affidavit of the prior year's rental history.
- Operators file lodging tax returns with the Town.

This guide is general information, not legal or tax advice. Short-term rental rules, caps and fees change, and HOA covenants can be stricter than local law. Confirm the rules for a specific property with the licensing office, and with your attorney or tax advisor, before you buy or book guests.
